2. GENERAL TERMS AND CONDITIONS OF USE OF THE WEBSITE

Using or accessing the Website implies unconditional and unrestricted acceptance of the present general terms and conditions (hereafter “GTCU”) by any person that visits the Website (“Users”) as well as the policies described hereafter.

The User is encouraged to carefully read the regulations relating to marketing communication and in particular French law dated 21st June 2014 with regard to the collection of personal data, the “Informatique et Liberté” (Computer Technology and Freedoms) law of 6th August 2004 as well as the General Regulations on Data Protection (RGPD: n° 2016-679).

The present legal notices may be modified at any time and without prior notice by the Publishing Director. The modifications will take effect as soon as they are published online. The Users are thus encouraged to consult this page regularly so as to inform themselves of the possible modifications that have been made.

The object of the Website is to provide information on the range of activities of SEVD and its partners. It is an institutional website, for which the carrying out of online sales is not its object.

3. INTELLECTUAL PROPERTY

SEVD is the owner of the intellectual property rights and holds the rights of use on all the elements accessible on the Website, in particular the texts, images, graphics, logos, videos, icons and sounds.

Any reproduction, representation, modification, publication or adaptation of all or any of the elements of the Website, whatever the means or method used, is forbidden, except following prior written authorization from SEVD.

Any unauthorised use of the Website or any of the elements that it contains shall be deemed to constitute an infringement and will be subject to legal proceedings in accordance with the provisions of articles L.335-2 and following of the French Intellectual Property Code.

4. LIABILITY

In visiting our Website, the User recognises that their connection device enabling access to the Website (mobile terminal or tablet) remains entirely under their responsibility and that they should take all the appropriate measures to protect their own data, in particular against attacks through viruses.
SEVD cannot be held liable for the errors or omissions contained in the information available on our Website.

SEVD cannot be held liable for damages, direct and indirect (for example, a loss of market or a loss of an opportunity), caused by the User during access to the Website. As a User of our Website, the User is the sole person liable for the data which they consult.

The Website Host ensures the continuity of its service 24 hours a day, on every day of the year. It nevertheless reserves the right to interrupt the hosting service for the shortest possible durations, in particular for reasons of maintenance, improvement of its infrastructures, failure of its infrastructures or if the services generate a reputed abnormal traffic.

Neither SEVD nor the Website Host can be held liable in case of malfunction of the Internet network, telephone lines or computer material and telephone devices linked in particular to network congestion preventing access to the server.

Interactive spaces (such as the contact form) contain free fields at the Users’ disposal. SEVD reserves the right to delete, without prior notice, any content placed in these free fields and which violates the legislation applicable in France, in particular the provisions relating to the protection of Personal Data. In this case, SEVD also reserves the right to implicate the User for civil and/or penal liability, in particular in the case of messages of a racist, abusive, defamatory or pornographic character, whatever the media device used (text, photograph etc.).

5. CONFIDENTIALITY AND PERSONAL DATA POLICY

By “Personal Data”, we understand any information enabling, in whatever form, directly or not, the identification of the physical persons, to which it is applied (article 4 of French law no. 78-17 of 6th January 1978).

The terms “person concerned”, “controller and processor” and “sensitive data” carry the meaning defined by the Data Protection Act (RGPD: n° 2016-679)

The responsible party in charge of the processing determines the purposes and means of the Personal Data processing (e.g. names, e-mail addresses or other items of data). In the case of processing Personal Data on the Website, we process your Personal Data confidentially and in compliance with the regulation provisions in force relative to data protection.

5.2 Purpose of collected data

On our Website, Personal Data can be used for the following purposes:

  • To reply to the messages received via the Contact Form;
  • To enable browsing on the Website and the management of Users’ requests: connection and Website use data etc.;
  • To prevent and fight against computer-related fraud (spamming, hacking…): computer material used for browsing, IP address, password;
  • To carry out optional satisfaction surveys on: e-mail address;
  • To perform communication campaigns (sms, e-mail): telephone number, e-mail address.

5.3 Right of access, rectification and opposition

In compliance with the applicable regulation, the Website Users have the following rights:

  • Right to oppose the processing of the Users’ data (article 21 RGPD),
  • Right of portability of the data that the Users have provided when this data is the subject of automated processing based on their consent or on a contract,
  • Right to give general or specific guidelines on the fate of your Personal Data after your death.

5.4 Non-communication of Personal Data

SEVD does not allow itself to process, host or transfer the Data collected about its Users to countries located outside the European Union or those recognised as “unsuitable” by the European Commission without informing you of this beforehand.

SEVD undertakes to take all necessary precautions to preserve the security of the Data and in particular that this should not be communicated to non-authorised persons.

For the purposes mentioned in the above Section 5.2, the Personal Data concerning you may be transmitted to the different subsidiaries or subcontractors of SEVD in France. Within the limits of their respective duties and for the purposes referred to above, the main persons likely to have access to the Users’ data are principally our customer service agents.

5.5. Security

In order to ensure Personal Data security and confidentiality, SEVD uses networks protected by standard devices such as firewalls, pseudonymisation, encryption and passwords.

During the processing of Personal Data, SEVD takes all reasonable measures to protect it from any loss, misuse, non-authorised access, disclosure, alteration or destruction.

6. INTERNET HYPERTEXT LINKS, COOKIES AND TAGS.

The Website contains a certain number of hypertext links towards other websites, set up with SEVD’s authorisation. Our Website can direct the Users towards other websites or third-party applications; this constitutes a service made available to the User. SEVD has no control over these third-party websites, and we cannot be held liable for their content. It is consequently your responsibility to read carefully their respective General Terms and Conditions of Use, as well as their data protection policies.

6.1. « COOKIES »

A cookie is a small data file sent onto the User’s browser and recorded onto the User’s terminal (e.g. computer or smartphone), (hereafter Cookies). This file includes data such as the User’s domain name, the User’s Internet access provider, the User’s operating system, as well as the date and time of access. In no case are Cookies likely to damage the User’s terminal.

SEVD may process the User’s data concerning their visit to the Website, such as the pages consulted and the searches carried out. This data allows SEVD to improve the Website’s content and the User’s browsing.

SEVD may occasionally use Internet tags (also known as single pixel GIFs, clear GIFs, invisible GIFs and 1-by-1 GIFs) and deploy them through a Website analysis specialist partner that may well be located (and therefore store the corresponding data, including the User’s IP address) in a foreign country.

These tags are placed both in online adverts allowing internet users to access the Website, and on its different pages.

This technology enables SEVD to evaluate the degree of engagement of the Users on the Website and the efficiency of certain sections (e.g. the number of times a page has been opened and the information consulted).

The Website Host may collect data on the visitors to the Website and to other internet websites, thanks to these tags, create reports on the Website’s activities for the attention of SEVD, and provide other services relative to the use of it and the Internet.

7. APPLICABLE LAW AND ATTRIBUTION OF JURISDICTION.

The present notices of our Website are governed by French law. Except for those cases whereby the law does not allow it, the courts of Libourne, 33500 France, shall have exclusive jurisdiction.
